These Terms & Conditions apply to the use of the Ballarat Agent Match website and our agent matching and referral service.

By submitting an enquiry, requesting an agent match or otherwise using our services, you acknowledge that you have read and agree to these Terms & Conditions.

1. About Ballarat Agent Match

Ballarat Agent Match is a property-related referral and agent matching service designed to help property owners connect with selected real estate agents operating in Ballarat and surrounding areas.

Our role is to introduce property owners to real estate agents who we believe may be suitable for their property and circumstances.

Ballarat Agent Match is not appointed as your selling agent through your use of this website and does not sell, market or negotiate the sale of your property on your behalf.

Any decision to appoint a real estate agent is made solely between you and the relevant agent.

2. Our Agent Matching Service

When you submit your details through Ballarat Agent Match, we may review information including your:

property address and suburb;
property type;
contact details;
expected selling timeframe;
property information you provide; and
any other relevant information submitted through our website or provided to us.

We may use this information, together with our knowledge of participating agents and the local property market, to identify agents we believe may be suitable for your property.

We may then provide your details to a limited number of selected participating agents so that they can contact you regarding your property and the possibility of representing you in a sale.

Submitting your details does not oblige you to appoint any agent introduced by Ballarat Agent Match.

3. How Agents Are Selected

Ballarat Agent Match works with a selected network of real estate agents.

We may consider factors including an agent's experience, local market knowledge, recent performance, property type experience, geographic area, availability and other factors we consider relevant when making an introduction.

Although we aim to recommend suitable agents, our recommendations are not a guarantee that a particular agent will achieve a specific result.

The final decision regarding which agent, if any, you appoint remains entirely yours.

We recommend that you speak directly with each agent, review their proposal, commission, marketing strategy, experience and sales authority before making your decision.

4. No Guarantee of Sale Price or Result

Any information provided by Ballarat Agent Match regarding property values, market conditions, agent performance or potential selling outcomes is general information only.

We do not provide a formal property valuation and do not guarantee:

the price your property will achieve;
that your property will sell;
the timeframe in which your property may sell;
the number of buyers who may be interested;
the performance of any particular agent; or
any financial outcome arising from the sale of your property.

Any estimated selling price or appraisal provided by an agent is the responsibility of that agent.

5. Ballarat Agent Match Does Not Act as Your Estate Agent

Unless expressly agreed otherwise in writing, Ballarat Agent Match does not act as your licensed estate agent, agent's representative, conveyancer, legal adviser, financial adviser or mortgage broker.

We do not negotiate the sale of your property, hold deposits, prepare contracts of sale or provide legal, conveyancing, financial, taxation or lending advice.

You should obtain appropriate independent professional advice where required.

6. Our Service Is Free for Property Owners

There is no fee charged by Ballarat Agent Match to property owners for using our standard agent matching and referral service.

Real estate agents introduced through Ballarat Agent Match operate independently and may charge commission, marketing expenses and other fees if you choose to appoint them.

Those fees are negotiated and agreed directly between you and the agent and should be clearly set out in the sales authority you enter into with that agent.

Ballarat Agent Match does not determine the commission or marketing fees charged by an agent.

7. Referral Fees and Commission Sharing

Ballarat Agent Match operates commercially and may receive a referral fee, commission share or other payment from a participating real estate agency or agent where a property owner introduced through our service appoints that agency and/or a successful property transaction occurs.

This payment is made under an arrangement between Ballarat Agent Match and the participating agency and is not an additional fee charged directly to you by Ballarat Agent Match.

Where applicable, the estate agency may have legal obligations to disclose commission-sharing arrangements to you before you sign a sales authority.

You should carefully review the agent's sales authority and any commission-sharing disclosure provided to you before appointing an agent.

Our commercial relationship with participating agents does not oblige you to appoint any agent we introduce.

8. Your Relationship With the Agent

Any agent introduced by Ballarat Agent Match is an independent business or professional and is not an employee, partner or representative of Ballarat Agent Match.

If you decide to appoint an agent, the agreement to sell your property is between you and the relevant estate agency.

The agent or agency is responsible for its own conduct, advice, representations, marketing, negotiations, services and compliance with applicable laws.

You should carefully read and understand the sales authority before signing it.

9. Your Information and Consent to Contact

When you submit an agent matching request, you authorise Ballarat Agent Match to use the information you provide for the purpose of assessing your enquiry, providing our service and identifying suitable participating agents.

You also authorise us to provide relevant contact and property information to the selected agents we match with you so that those agents may contact you regarding the potential sale of your property.

Your personal information will otherwise be handled in accordance with our Privacy Policy.

Please read our Privacy Policy before submitting your information.

10. Accuracy of Information You Provide

You agree that information you provide to Ballarat Agent Match will be accurate and not intentionally misleading.

You must not submit another person's personal information or property details without appropriate authority or permission to do so.

If you are acting on behalf of another property owner, estate, company, trust or other entity, you confirm that you have authority to make the enquiry and provide the relevant information.

11. Website Information

Information contained on the Ballarat Agent Match website, including articles, blogs, guides and market information, is provided for general informational and educational purposes.

Property markets and individual circumstances can change, and information published on our website may not apply to your particular circumstances.

Nothing on our website should be treated as legal, financial, taxation, conveyancing or professional property advice.

You should obtain independent professional advice where appropriate.

12. Third-Party Services

appoint an agent;
accept an appraisal;
enter into a sales authority; or
use any other professional or service provider introduced through our platform.

You remain in control of whether you proceed with any introduction or service.

14. Intellectual Property

Unless otherwise stated, the content of the Ballarat Agent Match website, including our branding, written content, graphics, design and original materials, is owned by or licensed to Ballarat Agent Match.

Website content must not be copied, reproduced, republished or commercially used without our prior written permission, except where permitted by law.

15. Website Availability

We aim to keep our website and services available and accurate but cannot guarantee uninterrupted or error-free access.

We may change, suspend or discontinue parts of the website or service from time to time.

16. Liability

To the extent permitted by law, Ballarat Agent Match is not responsible for losses arising solely from your decision to appoint or not appoint a particular third-party agent or service provider, or from acts or omissions of an independent third-party provider.

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

17. Complaints

If you have a concern about Ballarat Agent Match or our matching service, please contact us through the Contact page on our website.

If your complaint relates to the conduct, commission, marketing expenses or services of an estate agent you have appointed, you should first raise the matter directly with that agency and may also have rights to contact Consumer Affairs Victoria or another relevant regulatory body.

18. Changes to These Terms

Ballarat Agent Match may update these Terms & Conditions from time to time.

The latest version will be published on our website together with the date it was last updated.

Continued use of our website or services after changes are published constitutes acceptance of the updated Terms to the extent permitted by law.

19. Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia.

Any dispute relating to these Terms or the use of Ballarat Agent Match will be subject to the jurisdiction of the courts and tribunals of Victoria and any applicable Commonwealth jurisdiction.
